Citizen petitions and legislative bills in seven states in the US have established space and movement limitations for selected species of farm animals. These actions show Americans becoming concerned about the humane treatment of confined farm animals, and willing to use governmental intervention to preclude existing confinement practices. The individual state provisions vary, including the coverage of species. All seven states deal with sow-gestation crates, five states address veal calf crates, and two states’ provisions also apply to battery cages used (...) for egg-laying hens. The actions show citizen and legislative opposition to current animal production practices, and suggest a movement to provide better treatment for farm animals. Accompanying the actions are challenges for animal production industries in remaining competitive while meeting social expectations on the ethical treatment of food animals. While the actions are only a small step in addressing welfare issues, they may be the beginning of a significant movement to do more to address human and animal welfare issues. (shrink)

In this paper, I argue that assertions about the value of diversity rely on contradictory and incommensurable claims. As a result, institutions like the Supreme Court find it impossible to articulate an impartial standard for the appropriate use of race in college admissions. I argue that in the absence of such a standard, institutions inevitably fall back on engineering proportional racial outcomes, a method of college admissions that disproportionately harms minority students.

This chapter suggests that evidence should be viewed as a field of study, one to which most disciplines could contribute and from which most could benefit, and that generalisations should be viewed as part of that field. Every argument must be based upon a generalisation that can be stated as a major premise. The relationship between a supporting proposition or propositions and an inferred proposition can be restated in a quasi-deductive form by identifying the generalisation upon which the inference depends. (...) A datum or a proposition can be evidence if and only if it alters the probability, positively or negatively, of a proposition to be inferred. In order to demonstrate that an evidential proposition is relevant, an analyst must be able to identify and articulate a generalisation that justifies the claim that the evidential proposition alters the probability of an inferred proposition. This chapter develops these ideas and presents a method of generalisation-analysis. It also argues that generalisation-analysis is a tool in the field of evidence that could be useful in analysing and critiquing arguments in many disciplines. (shrink)

Agritourism activities have gained importance as a mechanism for some farmers to broaden their sources of income. As businesses have pursued agritourism activities, they have been concerned about liability for personal injuries of participants. In some states, providers of agritourism activities have presented legislators with ideas for an agritourism statute to limit liability for injuries resulting from inherent risks. Four new agritourism statutes have been enacted, while six other states have adopted alternative liability provisions that may apply to some agritourism (...) providers. The agritourism statutes provide an affirmative defense to providers to eliminate liability for inherent-risk injuries. An analysis of the statutory provisions shows legislatures making choices on the assignment of liability for accident injuries and the ability of providers to obtain releases from negligence. Because the agritourism statutes impose prerequisites and do not stop meritless lawsuits, they do not offer much assistance to agritourism providers. An evaluation of policy issues suggests that legislatures might consider additional options to address agritourism providers’ concerns. (shrink)

Following a synthesis of naturalistic and experimental studies of language creation, we propose a theoretical model that describes the process through which human communication systems might arise and evolve. Three key processes are proposed that give rise to effective, efficient and shared human communication systems: motivated signs that directly resemble their meaning facilitate cognitive alignment, improving communication success; behavioral alignment onto an inventory of shared sign-to-meaning mappings bolsters cognitive alignment between interacting partners; sign refinement, through interactive feedback, enhances the efficiency (...) of the evolving communication system. By integrating the findings across a range of diverse studies, we propose a theoretical model of the process through which the earliest human communication systems might have arisen and evolved. Importantly, because our model is not bound to a single modality it can describe the creation of shared sign systems across a range of contexts, informing theories of language creation and evolution. The purpose of this study is to provide evidence that Ibn Bāǧǧa’s commentaries on al- Fārābī’s logical writings reveal a perpetuation of al-Fārābī’s logic in Andalusia and that they also assist us in the recognition of the nature and achievement of this logic. Ibn Bāǧǧa’s Introduction or Eisagoge is a commentary on al-Fārābī’s introductory Letter and the Five Aphorisms, as well as subsequent logical treatises of al-Fārābī. Ibn Bāǧǧa, in agreement with al-Fārābī, presents logic as consisting of five syllogistic arts, (...) rhetoric, poetry, dialectic, sophistry and demonstration. These arts are constituted by both the form and matter of logic, the matter referring to the five syllogistic arts in which the form of logic is employed. Ibn Ḫaldūn later testifies to this comprehensive account of the five syllogistic arts articulated primarily by al-Fārābī but also in some measure by Ibn Sīnā, and says that, by his time, this account of the syllogistic arts had been replaced by a more limited a... Interest groups are advancing new statutory provisions to limit the liability of persons involved in equine activities. The first statute was adopted in Washington State five years ago, and subsequently twenty-nine other states have proceeded to adopt legislation regarding this issue. The new statutes, termed “Equine Liability Statutes,” provide immunity from liability for injuries and death arising from ordinary risks of equine activities. Drawing from policies involving the provision of assistance for needy interest groups and voluntary social prerequisites, two recommendations (...) may be proffered. First, the good samaritan and recreational use models suggest that the statutes might require a donation to offset the loss of participants' rights before a person could qualify for the statutory dispensation. Second, an additional safety prerequisite regarding a helmet to encourage action to reduce head injuries may be appropriate to foster safer equine activities. (shrink)

Animal feeding operations have come under increased scrutiny as sources of water pollution. Due to the concentration of animals at individual locations and in certain regions, the local environment may not be able to use all of the nutrients contained in the manure. Particularly, problematic are waters being impaired by nitrogen and phosphorus from animal manure. Since federal and state regulations have not been totally successful in precluding water contamination from manure nutrients, scientists and policymakers might seek ways to encourage (...) the use of manure as a resource for crop production. By analyzing diverse state regulations, this paper identifies several strategies that would treat animal waste as a recyclable production input rather than a production byproduct. Citizens and regulators can encourage more sustainable livestock production by proffering regulations that mandate selected production requirements or practices. Agronomic rate regulations, limitations on manure application and timing, lagoon safety requirements, closure mandates, and alternative uses of manure constitute possibilities to remedy some pollution problems. The article will focus on the implicit values dimension that is evident in research findings concerning quality teaching. Furthermore, it sets out to demonstrate that maximizing the effects of quality teaching requires explicit attention to this values dimension and that this can be achieved through a well-crafted values education program. Evidence for this latter claim will come from international studies as well as from the Australian Government's Values Education Program and, especially from the Values Education Good Practice Schools Project Stage (...) 1 Report (DEST, 2006). In this review, we focus on the evolutionary and biomedical aspects of the architecture of human chromosome 3 (HSA3) by analyzing chromosomal regions that have been conserved during the evolutionary process, compared to those that have been involved in the genomic restructuring of different placental lineages. Given that the organization of human chromosome 3 is derived when compared to the ancestral primate karyotype, and is an autosome that is commonly implicated in human tumour formation, we examined the patterns of change (...) and the genomic consequences that have resulted from its complex evolutionary history. The data show four discrete chromosomal regions that are frequently implicated in chromosomal rearrangements (3p25, 3p22, 3p12 and 3q21). These are rich in repetitive elements and are commonly implicated in structural rearrangements that underpin human genomic disorders and neoplasias. This target article examines the clinical and experimental evidence for a role of peripheral and central hyperexcitability in persistent pain in four key areas: cutaneous hyperalgesia, referred pain, neuropathic pain, and postoperative pain. Each suggests that persistent pain depends not only on central sensitization, but also on inputs from damaged peripheral tissue. It is instructive to think of central sensitization as comprised of both an initial central sensitization and an ongoing central sensitization driven by inputs from peripheral sources. Each of (...) these factors, initial sensitization, ongoing central sensitization, and inputs from peripheral sources, contributes to the net activity in dorsal horn neurons and thus influences the expression of persistent pain or hyperalgesia. Since each factor, peripheral inputs and central sensitization (initial or ongoing), can contribute to both the initiation and maintenance of persistent pain, therapies should target both peripheral and central sources of pathology. The commentaries on our target article have raised important issues about central neuroplasticity and its role in persistent pain states. Some suggest that central neuroplasticity plays nothing more than a minor role in persistent pain, while others argue that persistent pain depends critically on peripheral inputs for its maintenance. Some stress that persistent pain relies to a large extent on changes in the brain and on centrifugal inputs from brain to spinal cord, whereas others argue that it depends on alterations (...) in inhibitory as well as excitatory systems. We attempt to addresseach of the commentators' points, while defending our position that central neuroplasticity is critical to pathological persistent pain states. (shrink)

Our understanding of genomic reorganization, the mechanics of genomic transmission to offspring during germ line formation, and how these structural changes contribute to the speciation process, and genetic disease is far from complete. Earlier attempts to understand the mechanism(s) and constraints that govern genome remodeling suffered from being too narrowly focused, and failed to provide a unified and encompassing view of how genomes are organized and regulated inside cells. Here, we propose a new multidisciplinary Integrative Breakage Model for the study (...) of genome evolution. The analysis of the high‐level structural organization of genomes (nucleome), together with the functional constrains that accompany genome reshuffling, provide insights into the origin and plasticity of genome organization that may assist with the detection and isolation of therapeutic targets for the treatment of complex human disorders. In my comments on Prof. Sterba’s paper, I argue that evidence about the educational value of racial preferences reveals not that these policies produce good educational outcomes, but that schools use racial preferences regardless of whether they produce desirable outcomes. I further argue that in the absence of objective evidence about the value of racial preferences, proponents of these policies tend to rely on personal anecdotes. Often, these anecdotes reveal complex institutional and personal motives having little to do with the (...) objective value of racial diversity. (shrink)

BackgroundThe ARRIVE (Animal Research: Reporting of In Vivo Experiments) guidelines are widely endorsed but compliance is limited. We sought to determine whether journal-requested completion of an ARRIVE checklist improves full compliance with the guidelines.MethodsIn a randomised controlled trial, manuscripts reporting in vivo animal research submitted to PLOS ONE (March–June 2015) were randomly allocated to either requested completion of an ARRIVE checklist or current standard practice. Authors, academic editors, and peer reviewers were blinded to group allocation. Trained reviewers performed outcome adjudication (...) in duplicate by assessing manuscripts against an operationalised version of the ARRIVE guidelines that consists 108 items. Our primary outcome was the between-group differences in the proportion of manuscripts meeting all ARRIVE guideline checklist subitems.ResultsWe randomised 1689 manuscripts (control: n = 844, intervention: n = 845), of which 1269 were sent for peer review and 762 (control: n = 340; intervention: n = 332) accepted for publication. No manuscript in either group achieved full compliance with the ARRIVE checklist. Details of animal husbandry (ARRIVE subitem 9b) was the only subitem to show improvements in reporting, with the proportion of compliant manuscripts rising from 52.1 to 74.1% (X2 = 34.0, df = 1, p = 2.1 × 10−7) in the control and intervention groups, respectively.ConclusionsThese results suggest that altering the editorial process to include requests for a completed ARRIVE checklist is not enough to improve compliance with the ARRIVE guidelines. Other approaches, such as more stringent editorial policies or a targeted approach on key quality items, may promote improvements in reporting. (shrink)

Since the Niels Bohr centenary of 1985 there has been an astonishing international surge of scholarly analyses of Bohr's philosophy. Now for the first time in Niels Bohr and Contemporary Philosophy Jan Faye and Henry Folse have brought together sixteen of today's leading authors who have helped mould this new round of discussions on Bohr's philosophy. In fifteen entirely new, previously unpublished essays we discover a surprising variety of the different facets of Bohr as the natural philosopher whose `framework of (...) complementarity' shaped the final phase of the quantum revolution and influenced two generations of the century's leading physicists. There is much on which the authors included here agree; but there are also polar disagreements, which assure us that the philosophical questions revolving around Bohr's `new viewpoint' will continue to be a subject of scholarly interest and discussion for years to come. This collection will interest all serious students of history and philosophy of science, and foundations of physics. (shrink)

Les vingt-cinq tomes de l'édition allemande de référence de Cassirer ne sont disponibles que depuis 2007.0S'y s'ajoutent les dix-sept tomes du Nachlass depuis 2017. Des 102 volumes de la Gesamtausgabe de Heidegger, (...) édition de référence mais sans garantie scientifique, moins d'une dizaine reste programmée, mais d'ores et déjà la publication des cinq premiers volumes des Cahiers noirs a permis d'engager une relecture critique de l'ensemble. C'est donc à présent seulement que l'on peut véritablement évaluer les projets contrastés des deux auteurs.0Leurs enjeux intéressent notamment le statut de la rationalité et des sciences, en particulier celles de la culture, aussi bien que le statut de la technique parmi les formes symboliques. Et tout autant, l'opposition entre la démocratie et la théologie politique ; entre la légitimité du cosmopolitisme et l'ontologie identitaire ; enfin, entre la possibilité même d'une éthique ou son rejet de principe.0Tous ces thèmes contradictoires exigent aujourd'hui une révision critique, non seulement rétrospective, mais aussi ancrée dans le présent.
